Terms and conditions
The following terms and conditions apply to the NorthernTel Mobility
WirelessCare Maintenance Plan* (“the plan”). Please read these terms and
conditions carefully. If you have any questions concerning these terms
and conditions, you may contact NorthernTel Mobility’s Repair Department
at *611 or 1 800 360-8555.
Please note that these terms and conditions apply in addition to
NorthernTel, Limited Partnership’s (“NorthernTel”) Terms of Service for
telecommunication services which are provided by NorthernTel on an
unregulated basis (“Terms of Service”). You may obtain a copy of the
Terms of Service by looking at the introductory pages of the NorthernTel
telephone directory, by visiting our website at
www.northerntelmobility.com or by calling us at 1 800 360-8555. To the
extent that there is a conflict between these terms and conditions and
the Terms of Service, the Terms of Service shall prevail.
Included in the plan
- Replacement, or at the discretion of NorthernTel Mobility or its authorized provider, WCC, repair of your
wireless phone** in the event of loss, theft, defect or damage resulting
from normal use, and subject to the exclusions set out in the paragraphs
below.
- Pick-up of the defective wireless phone and shipping of the
replacement or repaired wireless phone and accessories.
Excluded from the plan
- Any defect or damage that existed prior to the plan subscription
date.
- Any defect or damage to the wireless phone caused by a power
surge, liquid damage, physical damage, damaged screen, improper
installation, improper use of the wireless phone, misuse, negligence
or vandalism.
- Normal wear and tear including changes to colour, texture,
finish or cosmetic damage, including to the interchangeable
faceplates.
- Any crack that does not affect the operation of the wireless
phone.
- Accessories and any defect or damage to the wireless phone
caused by accessories such as carrying cases, headsets, cords,
equipment specially designed for the hearing impaired, adapters and
any other similar device.
- Routine maintenance of the wireless phone by the authorized
provider, WCC, and replacement of consumable items, such as
batteries.
- Any antenna, wiring or cabling that connects the wireless phone
to any type of vehicle.
- Any upgrade due to the obsolescence of the wireless phone or any
of its components, including technological obsolescence.
- Any defect or damage to the wireless phone caused by an
infestation.
- Any defect or damage to the wireless phone caused by an act of
God, including but not limited to a natural catastrophe, fires,
floods, lightning, ice storm or acts of war.
- Any problem resulting from a manufacturing defect or design
defect of the wireless phone.
- Any problem resulting from improper maintenance or repair
performed by a party other than NorthernTel Mobility or an
authorized provider of NorthernTel Mobility.
- The Motorola M800 (Bag version) is not included in NorthernTel
Mobility's WirelessCare Maintenance Plan.
Other terms and conditions
- Your wireless phone must be activated on the NorthernTel
Mobility network to benefit from the plan.
- The plan fee will be billed monthly on your NorthernTel Mobility
bill commencing with your first NorthernTel Mobility bill following
your subscription to the plan.
- The coverage is effective on the date verbally indicated by the
NorthernTel Mobility representative at the time of your subscription
to the plan.
- Claims made under the plan may not be made until the first
business day following the expiration of 15 days after the
subscription date.
- Claims for replacement or repair of a wireless phone, made under
the plan, are limited to two claims per 12-month term.
- The minimum term of the maintenance plan is 12 months from date
of subscription.
- Cancellation fees apply if the plan is cancelled prior to the
expiration of the minimum 12-month term.
- To find out about the cancellation fees that apply to your plan,
visit www.northerntelmobility.com or contact one of our
representatives. There is no cancellation fee if you cancel the plan
after the minimum 12-month term.
- After the minimum 12-month term, the plan remains in effect
under the same terms and conditions unless NorthernTel Mobility
modifies or cancels the plan or you decide to terminate the plan, as
the case may be.
- You must contact NorthernTel Mobility to terminate your
subscription to the plan. The termination of the plan will be
effective 24 to 48 hours after your verbal notice to this effect.
Please be advised that NorthernTel Mobility may terminate the plan
upon notice to you.
- NorthernTel Mobility and/or the authorized provider WCC reserves
the right to charge additional fees or terminate the plan should it
deem that a customer is acting in an abusive manner, is not
fulfilling his/her obligations under the plan or is not paying the
monthly fee when due.
- Claims made under the plan must be made to NorthernTel
Mobility’s authorized provider, WCC, using the contact information
set out below. NorthernTel Mobility shall notify you should there be
a change of authorized provider.
- You may not assign your rights under the plan to any person
without the prior written consent of NorthernTel Mobility.
- Any replacement wireless phone will be the same model or a model
of similar quality and functionality, i.e. refurbished or new, at
NorthernTel Mobility’s or its authorized provider’s, WCC, sole
discretion. When your wireless phone is replaced by another model,
you will receive the accessories required for its operation, i.e.
the battery, basic charger and user guide.
- In any case of loss or theft, a duly completed police report is
required and a deductible of $35 will be charged by the authorized
provider, WCC.
- It is important to note that following the replacement of a loss
or stolen wireless phone covered during the WirelessCare Maintenance
Plan, NorthernTel Mobility will remove and disconnect the wireless
phone from the network in a manner that it will be unusable
permanently on NorthernTel Mobility’s network. If the unusable
wireless phone that was subject of the claim is found and is in good
working condition, this wireless phone should be returned to the
authorized provider, WCC, by respecting the standard claim
procedures.
- You agree that NorthernTel Mobility, its affiliates, directors,
officers, employees, agents and subcontractors, including but not
limited to the authorized provider, WCC, total cumulative maximum
liability arising directly or indirectly from the plan is as set out
in the Terms of Service. Except as set out herein, each of
NorthernTel Mobility and the authorized provider, WCC disclaims all
warranties of any kind, whether expressed, implied or statutory, in
respect of the wireless phone including any warranty of
merchantability or fitness for a particular purpose.
- In no event shall either NorthernTel Mobility, its affiliates,
directors, officers, employees, agents and subcontractors, including
but not limited to the authorized provider, WCC, be liable for any
indirect, special, incidental or consequential damages whatsoever
arising out of or in connection with this WirelessCare Maintenance
Plan contract (including loss of data, loss of use, loss of calls,
unused airtime, ring tones, downloaded applications, personal
information or pictures, lost profits or failure to realize expected
savings or any other commercial or economic loss, or any third party
claim) whether arising in negligence, tort statute, equity,
contract, common law, or any other cause of action or legal theory
even if NorthernTel Mobility has been advised of those damages.
These provisions shall survive the termination of the plan.

contact the authorized provider, WCC, at 1 877 281-1931, within 15 days
of your subscription date to ensure your wireless phone is registered.

** The term “wireless phone” must be interpreted in the broad sense of
the term and includes all phones activated on the NorthernTel Mobility
network regardless of the technology used (analog, digital, dual mode,
tri-mode, 1X or other).
